Information You Send Us About a Legal Matter
Contacting us through the Site, by phone or by email does not by itself make you our client or create an attorney-client relationship. We become your lawyers only when we agree to represent you.
Even so, we treat what you share with us while seeking legal help as confidential, as the Virginia Rules of Professional Conduct require for prospective clients, even if we never represent you. We use it to check for conflicts of interest and to decide whether we can help. Please keep your first message brief, and do not send confidential or time-sensitive details through the Site's forms. If your matter is urgent, call us.
Personal Information We Collect
Consultation and contact requests. When you send a request through a form on the Site, we collect your name, email address, phone number, the type of legal matter you choose, your message, and whether you used the English or Spanish form. With each request, our server also records your IP address, your browser type and the page that referred you.
Ad and campaign details. If you arrive from an online ad or from a link with campaign tags, the Site notes the page you arrived on and the campaign details in the link, such as utm tags or the ad click identifiers used by Google, Microsoft and Meta. These details are kept in your browser for 30 days and sent with any request you submit, so we know which page or ad brought you to us.
Visit records. Our own visit counter, which runs on our server, records the pages you view, the site that referred you, any campaign tags, your IP address, your approximate location (country, region and city, looked up from your IP address on our own server), and your browser and device type. If your browser sends a "Do Not Track" signal, the counter does not record your visit.
Chat messages. If you use the live chat on the Site, we collect the messages you send and any contact details you include.
Phone calls. We use call tracking, so a phone number shown on the Site may be a forwarding number. When you call it, our call-tracking provider records details such as your phone number, the time and length of the call, and the page or ad that led to the call. If call recording is turned on, the recording is also collected, and you will hear a notice before the call is recorded.
Maps. When you view a map of our office or follow a link for directions, Google receives information such as your IP address and, if you allow it, your location.
Analytics and advertising data. Google Analytics, Google Ads and the Meta Pixel use cookies and similar technologies to collect information about how you use the Site, such as the pages you visit, the ad you clicked, and your browser and device.
How We Use Your Information
We use the information above to:
- answer your request and talk with you about your legal matter;
- check for conflicts of interest and decide whether we can represent you;
- keep a record of our communications with you;
- understand which pages, searches and ads bring people to us, and improve the Site;
- measure and improve our advertising;
- protect the Site and its forms from spam, abuse and security threats; and
- meet our legal and professional obligations.
We do not sell your personal information, and we do not use what you tell us about your legal matter for advertising.
EU and UK visitors. If the GDPR or UK GDPR applies to you, we rely on these legal bases: steps you ask us to take before we agree to represent you (answering your request), our legitimate interests (conflict checks, records, Site analytics and security), our legal obligations, and your consent (advertising cookies and pixels).
Who We Share Information With
We share personal information only with service providers that help us run the Site and our practice, and only as needed for the purposes above:
- Google Analytics (Google LLC): statistics about how the Site is used.
- Google Ads (Google LLC): advertising and measuring which ads lead to contacts.
- Meta Pixel (Meta Platforms, Inc.): measuring ads we run on Facebook and Instagram.
- CallRail: call tracking.
- Google Maps (Google LLC): maps and directions to our office.
- Our live-chat provider: handling chat messages.
- Our website host and email provider: storing form requests and delivering them to our inbox.
We may also disclose information when the law requires it, such as in response to a valid subpoena or court order, when the Virginia Rules of Professional Conduct permit or require it, or to protect our rights or the safety of others.
International Visitors
We are based in the United States, and the Site and our service providers store information in the United States. If you contact us from another country, your information will be transferred to and processed in the United States, where privacy laws may differ from those where you live. Where the law requires it, these transfers rely on safeguards such as the European Commission's Standard Contractual Clauses.
How Long We Keep Information
We keep personal information for up to 12 months after we collect it, unless we need it longer. Information you send us about a legal matter may be kept longer when we need it to check for conflicts of interest or to meet our legal and professional obligations, and client files are kept as the rules governing lawyers require. Campaign details stored in your browser expire after 30 days. When information is no longer needed, we delete it or make it anonymous.
Your Choices and Rights
Everyone. You can ask us what personal information we have about you, ask us to correct it, or ask us to delete it, by emailing info@firstpointlaw.com or calling (703) 385-6868. We may need to confirm your identity, and we may keep information that we must retain for conflict checks or by law. We will not treat you differently for making a request.
EU and UK residents. You have the rights of access, correction, erasure, restriction, data portability and objection, and you can withdraw your consent at any time without affecting earlier processing. You may also complain to the data protection authority where you live.
California residents. You have the right to know what personal information we collect and how we use it, to delete it, to correct it, and to opt out of the "sharing" of personal information for cross-context behavioral advertising. Our use of Google Ads and the Meta Pixel may count as sharing. To opt out, contact us as described above.
Canadian residents. You may access and correct your personal information, withdraw your consent subject to legal or contractual limits, and complain to the Office of the Privacy Commissioner of Canada.
Cookies, Browser Storage and Analytics
Our own Site. Our server sets one session cookie when your browser contacts it, for example when a page view is counted or a form is sent. It is used for security and to keep the firm's own visits out of our visitor count, it holds no personal details, and your browser deletes it when you close it. The Site also uses your browser's storage for a few small items: a visit ID for our visit counter, whether you dismissed the language suggestion, and the campaign details described above. You can clear these at any time in your browser settings.
Third-party tools. Google Analytics, Google Ads and the Meta Pixel set their own cookies. You can limit them by:
- installing the Google Analytics Opt-out Browser Add-on;
- adjusting ad personalization in Google's My Ad Center and in your Meta ad preferences; and
- blocking or deleting cookies in your browser settings, although some features may then not work.
How We Protect Information
The Site uses encryption (HTTPS) on every page and form. Access to form requests and visit records is limited to our staff and the service providers that need it, and our administration area is password protected. No method of sending or storing information is completely secure, so we cannot guarantee absolute security.
Children's Privacy
The Site is not directed to children under 13, and we do not knowingly collect personal information from them. In family law matters, parents and guardians may tell us about their children, and we protect that information like any other information about a legal matter. If you believe a child under 13 has sent us information, contact us and we will delete it.
Changes to This Policy
We may update this policy from time to time. The effective date at the top of this page shows when it last changed.
